These Terms of Service (“Terms”) govern your use of the Stealward app and service (“Stealward”, “we”, “us”). Please read them carefully — they include important limits on our liability (Sections 10–12).
1. Acceptance
By downloading, accessing, or using Stealward, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use Stealward.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use Stealward. By using it, you confirm that you meet these requirements.
3. What Stealward is — and what it is not
Stealward is a best-effort monitoring aid: you activate it on a device you are leaving behind, and it watches your belongings and sends you alerts if something looks wrong.
Stealward is not a guaranteed security system, alarm service, or theft-prevention guarantee. Its effectiveness depends on things outside our control — device power and placement, camera view, network connectivity, and third-party notification delivery — and on automated (AI) analysis that can be incomplete or wrong. Do not rely on Stealward as your sole means of protecting your property or safety.
4. Your account and devices
- Stealward accounts are secured with cryptographic keys held on your own devices — there is no password, and no account credential we can reset on your behalf.
- You are responsible for safeguarding your devices and keys and for all activity under your account. You may link additional devices; you are responsible for the devices you link.
- Because your content is end-to-end encrypted, if you lose access to all of your devices and keys, we cannot recover your recordings or account data for you.
5. License to use Stealward
We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use Stealward for its intended purpose. You may not: copy, modify, reverse-engineer, decompile, or disassemble the app; resell, sublicense, or commercially exploit it; circumvent its security or access controls; use it to build a competing product; or use it in any unlawful way. We reserve all rights not expressly granted.
6. Subscriptions, billing, discounts & refunds
- App Store purchases. If you purchase a subscription through the Apple App Store, the purchase is processed by Apple and subject to Apple’s terms. Auto-renewal, cancellation, and refunds for those purchases are managed by Apple through your Apple account settings — refund requests for App Store purchases must be made to Apple, not to us.
- Direct and promotional purchases. Access obtained directly from us or through a promotional channel is governed by these Terms. Except where a non-waivable refund right applies under applicable law, we do not issue refunds after the refund period disclosed to you at the time of purchase.
- Discounts and promotions. We may offer discounts, promotional pricing, or complimentary access at our discretion. These may be time-limited, personal, non-transferable, and subject to change or withdrawal, and do not apply retroactively to prior purchases. Additional terms may be disclosed at the time of the offer.
- Price and plan changes. We may change prices and plans; any change applies to future billing periods.
- Taxes. Prices may be exclusive of applicable taxes, which you are responsible for.
7. Acceptable use and your responsibilities
You agree to use Stealward only for lawful purposes and in accordance with these Terms. In particular:
- Recording others. Stealward records video and audio of the area around your device and may capture other people. Laws on recording people — especially audio — vary by location and can require the consent of those recorded. You are solely responsible for using Stealward lawfully, including obtaining any consent required where you are, and for not recording where it is prohibited.
- Loud alarm. When Stealward detects tampering or movement, it may sound an alarm through the device at the device’s maximum volume. The alarm is designed to play through the device’s built-in speaker rather than connected headphones, and to ramp up gradually rather than starting at full volume — but these safeguards are best-effort and you must not rely on them. Do not arm Stealward on a device connected to headphones, earphones, or any other audio device worn on or near anyone’s ears, and do not place an armed device close to anyone’s ears. You are responsible for positioning an armed device so that the alarm cannot cause hearing injury to you or others.
- No misuse. You will not use Stealward to stalk, harass, surveil, or record any person unlawfully, or to violate anyone’s privacy or rights.
- No interference. You will not attempt to disrupt, overload, probe, or gain unauthorized access to the service or its infrastructure, or to circumvent its protections.
You are responsible for how you deploy Stealward and for the consequences of any recordings you make.
8. Privacy
How we handle your data is described in our Privacy Policy, which forms part of these Terms.
9. Availability and changes to the service
We may add, modify, suspend, or discontinue any part of Stealward at any time, and availability may vary by region. We do not guarantee that the service will be uninterrupted, timely, secure, or error-free.
Access to Stealward requires an internet connection that we do not control. Internet service providers, network operators, or governmental authorities in some regions may restrict, filter, or block access to Stealward or to the third-party infrastructure it relies on. We are not responsible for any unavailability, degradation, or failure of the service — including any failure to deliver alerts — caused by such restrictions, and such restrictions do not entitle you to a refund except where a non-waivable right applies under applicable law. We make no representation that Stealward is available or appropriate for use in every location. You are responsible for obtaining and maintaining your own internet access.
10. Disclaimers
To the maximum extent permitted by law, Stealward is provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Without limiting this, we do not warrant that Stealward will detect any threat, prevent theft or loss, deliver alerts accurately or on time, or operate without errors or interruptions. Threat detection relies on AI and may produce inaccurate or incomplete results. You use Stealward at your own risk.
11. Limitation of liability
To the maximum extent permitted by law, Stealward and its operators will not be liable for: any theft, loss, or damage to property; any failure to detect an event or deliver an alert, or any delay in doing so; any loss of data; any hearing or other injury resulting from the alarm sounding, including where a device was placed near a person’s ears or connected to headphones contrary to Section 7; any inability to access or use Stealward caused by restrictions, filtering, or blocking imposed by internet service providers, network operators, or governmental authorities; or any indirect, incidental, special, consequential, or punitive damages, arising out of or relating to your use of, or inability to use, Stealward — even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to Stealward will not exceed the greater of (a) the total amount you paid us for the service in the 12 months before the event giving rise to the claim, or (b) USD 25.
Some jurisdictions do not allow certain warranty or liability exclusions, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Stealward and its operators from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of Stealward, the recordings you make, your violation of these Terms, or your violation of any law or the rights of any third party — including any recording, wiretap, or privacy laws.
13. Termination
We may suspend or terminate your access at any time if you breach these Terms or misuse the service. You may stop using Stealward at any time. Provisions that by their nature should survive termination — including Sections 10 (Disclaimers), 11 (Limitation of liability), and 12 (Indemnification) — will survive.
14. Changes to these Terms
We may update these Terms from time to time. When we make a material change, we will update the version and effective date above and, where appropriate, ask you to review the new version in the app. Your continued use after an update means you accept the revised Terms.
15. Governing law and disputes
These Terms are governed by applicable law. We prefer to resolve concerns informally first — please contact us before pursuing any formal dispute, and we will try to help.
A specific governing jurisdiction and dispute-resolution process are intentionally left open for now and should be added before broader launch.
16. Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding Stealward. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
